Urgent Appeal from Odesa City Council Members

Members of the Odesa City Council have reached out to the Verkhovna Rada and the Cabinet of Ministers of Ukraine, requesting urgent legislative action to regulate the issue of compensation for damaged property under the «eRecovery» program for residents of buildings recognized as cultural heritage sites.

Apartment owners in these damaged heritage buildings, like all other citizens of Ukraine, are entitled to compensation for damaged property in accordance with the Law of Ukraine «On Compensation for Damage and Destruction of Certain Categories of Real Estate Due to Military Actions, Terrorist Acts, and Aggression by the Russian Federation».

However, compensation for residents of affected heritage buildings is currently impossible due to certain legislative constraints:

Firstly, the Cabinet of Ministers of Ukraine Resolution No. 473 of April 19, 2022, «On the Approval of the Procedure for Urgent Work to Eliminate the Consequences of the Russian Federation's Armed Aggression», does not apply to cultural heritage sites, making it difficult to document damage and obtain compensation;

Secondly, the Cabinet of Ministers of Ukraine Resolution No. 1342 of November 15, 2022, which approves the Procedure for Certain Works on Cultural Heritage Sites During Martial Law, does not regulate the compensation process and is purely technical, only facilitating the permit process for works on heritage sites during wartime.

Throughout 2024, the Odesa City Council's executive committee has twice appealed to the Ministry of Culture and the Ministry of Community Development regarding this issue, but it remains unresolved.

Odesa City Council members have once again called for urgent legislative action to create conditions for residents of cultural heritage sites to receive compensation for their damaged property.
